Please read these terms carefully before booking or receiving services at Gemini Inked. By scheduling an appointment or receiving our services, you acknowledge and agree to be bound by these terms.
By booking an appointment, consultation, or receiving any services from Gemini Inked, you ("Client") acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not book or receive our services.
These terms apply to all services including but not limited to: Scalp Micropigmentation (SMP), Permanent Makeup, Hyperrealism Brows, Permanent Eyeliner, Scar Camouflage, and all related procedures.
2.1 Medical Disclosure: You must disclose all relevant medical conditions, medications, allergies, and health concerns during your consultation. Failure to disclose accurate health information may result in adverse reactions and voids any liability on the part of Gemini Inked.
Services are NOT suitable for clients who:
2.2 Age Requirement: Clients must be 18 years of age or older. Valid government-issued ID will be required at your appointment.
3.1 Consultation: All clients must complete a consultation prior to service. During this consultation, we will discuss your medical history, desired results, realistic expectations, risks, and aftercare requirements.
3.2 Consent Forms: You will be required to sign a detailed consent form acknowledging that you understand the procedure, potential risks, healing process, and aftercare instructions.
3.3 Realistic Expectations: While we strive for exceptional results, permanent makeup and SMP outcomes can vary based on individual skin type, healing ability, lifestyle factors, and adherence to aftercare. Results are not guaranteed to be identical to examples shown.
4.1 Deposits: A non-refundable deposit is required to secure your appointment. Deposit amounts vary by service and will be applied toward your total treatment cost.
4.2 Payment Methods: We accept cash, credit cards, debit cards, and approved financing options. Full payment is required on the day of service unless a payment plan has been pre-arranged. A 3.49% service fee will be applied to all debit card and credit card transactions to cover processing costs.
4.3 Pricing: Prices are subject to change and may vary based on treatment area, complexity, and individual client needs. Final pricing will be confirmed during consultation.
4.4 Internal Financing Program: Gemini Inked offers an internal financing program for qualified clients. By participating in this program, you agree to the following terms:

4.5 Third-Party Financing: Third-party financing options may also be available. You are responsible for understanding and complying with all terms of any third-party financing agreement. Gemini Inked is not responsible for third-party financing disputes.
5.1 Advance Notice: We require a minimum of 48 hours advance notice for cancellations or rescheduling. Failure to provide adequate notice will result in forfeiture of your deposit.
5.2 No-Shows: Clients who fail to show up for scheduled appointments without prior notice will forfeit their deposit and may be required to pay a rescheduling fee for future appointments.
5.3 Late Arrivals: Clients arriving more than 15 minutes late may need to reschedule, and deposits may be forfeited. We cannot guarantee completion of services if you arrive late.
5.4 Artist Cancellations: In the rare event that we must cancel or reschedule your appointment, you will receive full notice and your deposit will be applied to your rescheduled appointment or refunded at your request.
6.1 Aftercare Compliance: You are solely responsible for following all aftercare instructions provided by your artist. Failure to follow aftercare instructions may result in poor healing, infection, color loss, or unsatisfactory results.
Critical Aftercare Requirements:
6.2 Touch-Up Sessions: Most procedures require touch-up sessions for optimal results. Touch-up appointments are typically included within a specified timeframe (usually 6-8 weeks). Missed touch-up appointments may incur additional fees.
6.3 Long-Term Care: Permanent makeup and SMP will fade over time. Longevity depends on skin type, sun exposure, skincare routine, and lifestyle. Annual or bi-annual color refreshes may be needed to maintain optimal appearance.
7.1 Acknowledged Risks: You acknowledge and accept that all cosmetic tattooing procedures carry inherent risks, including but not limited to:
7.2 Limitation of Liability: To the fullest extent permitted by law, Gemini Inked, its owners, artists, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from services rendered, including but not limited to complications from undisclosed medical conditions, failure to follow aftercare instructions, or allergic reactions.
7.3 Client Assumption of Risk: By proceeding with services, you expressly assume all risks associated with the procedure and agree to hold Gemini Inked harmless from any claims, damages, or expenses arising from your treatment.
7.4 Medical Emergency: Gemini Inked is not a medical facility. In the event of a medical emergency during or after treatment, you are responsible for seeking appropriate medical care. We will assist in contacting emergency services if needed.
8.1 No Refunds: All sales are final. Due to the personalized nature of permanent makeup and SMP services, we do not offer refunds once services have been performed.
8.2 Deposit Non-Refundable: Deposits are non-refundable under all circumstances, including client cancellation, no-shows, or change of mind.
8.3 Touch-Up Warranty: We offer complimentary touch-ups within 6-8 weeks of initial procedure (as applicable to specific services). Touch-ups performed outside this window may incur additional charges.
8.4 Correction Services: If you are dissatisfied with your results, we will work with you to make reasonable corrections. However, correction services must be performed by Gemini Inked artists and are subject to artist availability and assessment.
9.1 Before & After Photos: With your consent, we may photograph your treatment area for before/after documentation. These photos may be used for marketing purposes, portfolio, social media, website, and promotional materials.
9.2 Opt-Out: You have the right to decline photography or request that your images not be used for marketing purposes. Please inform your artist if you wish to opt out.
9.3 Image Rights: By consenting to photography, you grant Gemini Inked perpetual, royalty-free rights to use your images in any media format for business purposes. Your identity may be anonymized upon request.
10.1 Professional Conduct: We maintain a professional, respectful environment. Clients are expected to treat our artists and staff with courtesy and respect at all times.
10.2 Prohibited Behavior: The following behaviors will not be tolerated and may result in immediate termination of services without refund:
10.3 Right to Refuse Service: Gemini Inked reserves the right to refuse or terminate services to any client at any time, for any reason, including but not limited to inappropriate behavior, undisclosed medical conditions, or failure to follow instructions.
11.1 Artistic Design: All designs, techniques, and artistic work created by Gemini Inked artists are protected intellectual property. You may not reproduce, copy, or request other artists to duplicate our proprietary designs or techniques.
11.2 Website & Content: All content on the Gemini Inked website, including text, graphics, logos, images, and software, is the property of Gemini Inked and protected by copyright laws. Unauthorized use is prohibited.
12.1 Financing Partners: We may offer third-party financing options for your convenience. Gemini Inked is not responsible for the terms, approval, or disputes related to third-party financing agreements.
12.2 External Links: Our website may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of external sites.
13.1 Personal Information: We collect and store personal information including contact details, medical history, and treatment records. This information is kept confidential and used solely for providing services and internal record-keeping.
13.2 HIPAA Compliance: While we are not a covered medical entity under HIPAA, we treat your health information with the highest level of confidentiality and will not disclose it to third parties without your consent, except as required by law.
13.3 Data Security: We implement reasonable security measures to protect your information. However, no method of electronic storage is 100% secure, and we cannot guarantee absolute security.
14.1 Right to Modify: Gemini Inked reserves the right to modify, update, or change these Terms of Service at any time without prior notice. Changes will be effective immediately upon posting to our website.
14.2 Continued Use: Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.
15.1 Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to conflict of law principles.
15.2 Arbitration Agreement: Any dispute, claim, or controversy arising out of or relating to these terms or services provided shall be resolved through binding arbitration in Birmingham, Alabama, rather than in court, except that you may assert claims in small claims court if your claims qualify.
15.3 Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and Gemini Inked individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.
15.4 Venue: If arbitration is not applicable, any legal action must be brought in the state or federal courts located in Jefferson County, Alabama, and you consent to the exclusive jurisdiction of such courts.
16.1 Severability: If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
16.2 Entire Agreement: These Terms of Service, along with any consent forms you sign, constitute the entire agreement between you and Gemini Inked regarding our services and supersede all prior agreements and understandings.
